Article 1 – Preamble and Definitions
1.1 Preamble
These General Terms and Conditions govern the terms and conditions of use of the Canella Camaiora® powered by TrueScreen® service, offered by Canella Camaiora Società tra Avvocati S.r.l., with registered office at Via Merlo, 3 – 20122 Milan, VAT IT09405500969 (hereinafter also referred to as “Studio CC®” or “Canella Camaiora®”). This service is intended for the digital certification of authorship of works and the evidentiary preservation of digital content through the use of timestamping technologies and file integrity certification.
Canella Camaiora® utilizes, for the technological component of the Service, the technology provided by TrueScreen S.r.l., with registered office at Via della Zecca n. 1, Bologna, 40121 (BO), VAT IT03920081209 (hereinafter “TrueScreen®”), which supplies the digital certification and timestamping system. Canella Camaiora® remains the sole entity contractually responsible to the User for the management of the Service, while TrueScreen® operates exclusively as a technology provider and has no direct relationship with the User (TrueScreen’s terms of service are available here: https://truescreen.io/en/tos/).
IMPORTANT NOTE: The Service does not constitute an official copyright registration with public or private entities but provides proof of authorship through digital certification. This proof may be used by the User in case of disputes or legal actions, but its evidentiary effectiveness depends on the regulations in force in the country where the proof is used and the assessments of the competent authorities.
1.2 Definitions
For the purposes of these General Terms and Conditions, the following terms shall have the meanings set forth below:
Provider: Canella Camaiora®, responsible for delivering the Service to the User.
TrueScreen®: the provider of the digital certification and timestamping technology (TrueScreen’s terms of service are available here: https://truescreen.io/en/tos/).
User: any individual or legal entity that uses the Service.
Service: the system that enables the User, with the assistance of the Provider, to obtain digital certification of a work’s authorship and to preserve digital evidence of violations and unlawful acts.
Timestamping: the process that assigns a certain date and time to a digital document, ensuring its integrity and authenticity.
Contract: these General Terms and Conditions.
Article 2 – Subject of the Contract
2.1 Purpose of the Service
This Contract governs the terms and conditions of use of the Canella Camaiora® powered by TrueScreen® Service, which allows the User to:
a) Digitally certify the authorship of a work by assigning it a timestamp that attests to the existence of the content at a specific time and ensures its integrity. b) Preserve digital evidence of violations or unlawful acts by certifying documents, multimedia files, screenshots, and other digital content to ensure their evidentiary validity.
2.2 Operation of the Service
To access the Service, the User must follow the procedure indicated by Canella Camaiora®, which includes:
Completing the interactive form, providing the required data, and uploading the files to be certified.
Transmitting the information to Canella Camaiora®, which will manage the digital certification process.
Performing the timestamping through TrueScreen® technology within 48 hours of receiving the data.
Confirming the completed certification to the User via email communication.
2.3 Limitations and Conditions of Use
Without prejudice to the fact that Canella Camaiora® merely provides a system for certification and preservation of digital evidence without any verification activity on the content of the files transmitted, the User accepts and acknowledges that:
Canella Camaiora® is not responsible for the content uploaded by the User and does not perform any verification of their novelty, originality, or legal validity.
The User is solely responsible for the quality of the uploaded files, including the readability of texts, the visibility of photographs, and the clear representation of the characteristics of the work or the violation to be documented for evidentiary purposes.
Canella Camaiora® does not guarantee that the certified content is unpublished, original, or free from third-party disputes.
Canella Camaiora® reserves the right to refuse certification if the uploaded content does not comply with these General Terms and Conditions or is unlawful, reserving the right to report the user to the competent authorities if necessary.
3.1 Service Activation
The User accesses the Service by following the procedure indicated by Canella Camaiora®, which involves filling in the interactive form and providing the required data. The activation of the Service is considered complete upon receipt by Canella Camaiora® of both the payment (if applicable) and the files to be certified.
3.2 Service Timing
Canella Camaiora® undertakes to complete the digital certification and timestamping within 48 hours from the receipt of the files and required information, except in cases of force majeure or technical issues beyond its control.
3.3 Certification Confirmation
Following certification and timestamping, Canella Camaiora® will send the User an email containing: a) confirmation of certification;
b) the certified digital document with timestamp;
c) any instructions for use of the certification.
3.4 Retention and Confidentiality
Canella Camaiora® will retain certified documents in its archives for a minimum of five (5) years from the date of certification, unless otherwise required by law or specifically agreed with the User.
Files uploaded by the User will be treated with the utmost confidentiality by both Canella Camaiora® and the technology provider TrueScreen®, in compliance with applicable data protection and information security laws.
The User is responsible for downloading, storing, and safeguarding the certified document received. Should the User require a file to be retrieved from the archive, the Canella Camaiora® Team can assist upon written request and reimbursement of out-of-pocket expenses and assistance fees.
4.1 Service Fees
The User shall pay Canella Camaiora® the applicable fee according to the current rates at the time of the request, as published on the official website or communicated directly by customer support.
Any additional services (such as retrieval of certified files from the archive) will be subject to specific fees, which will be communicated to the User in advance.
4.2 Payment Methods
Payments must be made via the methods indicated by Canella Camaiora®, currently supported by Stripe. Canella Camaiora® reserves the right to integrate additional payment systems.
Successful payment processing is a condition for service activation. In the event of non-payment or failed transaction, the Service will not be provided.
4.3 Invoicing and User Data
B2B clients – Canella Camaiora® will issue an invoice to the business or professional that made the payment. The User must provide accurate billing details when requesting the Service.
B2C clients – A payment receipt will be issued, unless the User requests an invoice before the receipt is issued.
Truthful data requirement – The User is required to provide truthful personal and fiscal information during registration and service request.
4.4 Refunds and Cancellations
Due to the nature of the Service and its execution process, the User must report any anomalies or errors in accordance with the following terms:
Once the certification and timestamping process is complete, the Service is considered executed, and no refund will be issued.
Errors attributable to Canella Camaiora® must be reported within 8 days from receipt of the certification.
Canella Camaiora® will assess reports and, if an error is confirmed, will issue a corrected certificate at no additional cost.
The right of withdrawal does not apply, pursuant to Art. 59(1)(a) of the Consumer Code (Legislative Decree 206/2005), as the service is performed upon specific request of the User and completed before the 14-day withdrawal period expires.
5.1 Scope of Liability
Canella Camaiora® guarantees the proper provision of the Service but shall be liable solely within the limits set out in these Terms and Conditions. The Service is provided “as is”, without warranty of specific outcomes or automatic recognition of the certification in any legal context.
5.2 Content Uploaded by the User
The User is solely responsible for the uploaded files and must ensure they are readable, relevant, and appropriate for the intended certification.
Canella Camaiora® does not check the quality, originality, or legal validity of the content and accepts no responsibility for disputes concerning the ownership or authorship of the certified work.
5.3 Evidentiary Validity of the Certification
The Service provides a form of evidence that may be used in legal proceedings; however, its recognition depends on the applicable laws and the decisions of the competent authorities.
Canella Camaiora® does not guarantee that the certification will be automatically accepted in every jurisdiction or legal proceeding.
5.4 Limitations due to Force Majeure
Canella Camaiora® is not liable for delays or service interruptions due to events beyond its control, including technical failures of the platform or TrueScreen® technology, connectivity issues, cyberattacks, infrastructure failures, natural disasters, or extraordinary events.
6.1 Proper Use of the Service
The User agrees to use the Service in compliance with these Terms and Conditions, applicable laws, and good faith.
Any fraudulent, unlawful, or improper use is strictly prohibited.
6.2 Accuracy of Information
The User guarantees that all data provided for accessing the Service, including personal and contact details, are accurate, up-to-date, and complete.
Canella Camaiora® shall not be liable for any consequences arising from incorrect or incomplete information.
6.3 File Requirements
To use the Service, files must meet the following technical requirements:
Maximum file size: 10 MB
Accepted formats: documents, images, videos, audio files, and ZIP folders
Upload method: via drag-and-drop or selection from the User’s device
Canella Camaiora® reserves the right to reject files that do not meet these criteria or that are corrupted or unreadable.
6.4 Responsibility for Uploaded Content
The User is solely responsible for ensuring that:
The files are readable and meet the required technical specifications;
The content is lawful, non-defamatory, and does not infringe third-party rights;
The files are free from viruses, malware, or harmful elements.
6.5 Storage and Access to Certified Documents
Canella Camaiora® retains certified files in its archives for a minimum of five years.
The User remains responsible for downloading and safely storing the certified document received.
If file retrieval is needed, Canella Camaiora® may assist upon written request and reimbursement of relevant costs.
7.1 One-Off Service
The User acknowledges that the Service is provided on a one-off basis and does not include any form of subscription or automatic renewal.
7.2 Deletion of Stored Files
Canella Camaiora® retains certified files for a minimum of five (5) years from the date of certification. After this period, files will be permanently deleted from the archives without further notice to the User.
7.3 Termination of the Contract
Canella Camaiora® reserves the right to suspend access to the Service and terminate the contract with immediate effect in the following cases:
Violation of these Terms and Conditions by the User;
Use of the Service for unlawful or improper purposes;
Compliance with legal obligations or requests from competent authorities.
8.1 Data Controller and Processor
Canella Camaiora® acts as Data Controller for the User’s personal data.
For the purposes of storage and certification, Canella Camaiora® appoints TrueScreen® as external Data Processor and custodian of the digital archives.
8.2 Applicability of the Privacy Policy
The processing of personal data is carried out in compliance with applicable data protection laws and the Privacy Policy published by Canella Camaiora®, available to Users on the official website.
9.1 Jurisdiction
Any dispute relating to the interpretation or performance of this Contract shall be subject to:
For business and professional Users (B2B): the exclusive jurisdiction of the Court of Milan;
For consumer Users (B2C): the competent court as determined by the User’s place of residence or domicile.
9.2 Attempt at Amicable Resolution
